Celebrity right and personality rights of superstar Rajinikanth got judicial approval on Tuesday when the Madras high court permanently restrained a film producer from releasing the Hindi film "Main Hoon Rajinikanth." "Personality right vests on those persons who have attained the status of celebrity," said Justice R Subbiah, granting permanent injunction on the release of the movie. 

The actor had moved the court saying, 'Shivaji Rao Gaekwad (also known as Rajinikanth)' earned recognition and adoration all over the world due to hard work, and that one Varsha Productions had made a film Main Hoon Rajinikanth styled after him, and even advertised it as his biopic. 

Noting that he had all along been avoiding advertisements and promotions and that he had not authorized anyone to make a biopic, he said the film based on his personal self/personality would mar his reputation. In September last year, the court admitted the actor's suit, and stayed imminent release of the film. 

On Tuesday, passing a detailed order and granting permanent injunction for the film's release, Justice Subbiah said: "Infringement of right of publicity requires no proof of falsity, confusion, or deception, especially when the celebrity is identifiable. On seeing the title of the movie, it could be easily inferred that the public perspective about the film appears to be only with reference to Rajinikanth alone, and not connected with any other person."
